Terms of Service

These Terms of Service ("Terms") govern your use of the website at studywithbloomed.com (the "Site"), the Bloomed app at app.studywithbloomed.com (the "App") and any account you hold with us (together, the "Services"), operated by "Bloomed" ("we", "us", "our").
By using the Services or creating an account, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 16 years old to use the Services and to create an account.
2. Your account
2.1 You may hold one account, and the details you give us must be accurate and kept up to date.
2.2 You sign in with a one-time link we email to you, or with your Google account. You are responsible for everything done through your account, so keep your email account and Google account secure and tell us promptly if you think someone else has used your account.
2.3 We may suspend or close your account if you breach these Terms, or if we reasonably need to in order to protect the Services or other users. You can close your account at any time by emailing us (section 11).
3. Using the Services
3.1 The question bank, explanations, answer options, teaching insights, stem annotations and everything else in the Services are provided for your own personal, non-commercial study only.
3.2 You agree not to:
•
copy, reproduce, publish, share, redistribute or sell any question, explanation, answer option, teaching insight or annotation, whether by screenshot, transcription or any other means;
•
scrape, harvest, bulk-download or extract content or data from the Services by automated or manual means, or use bots, scripts or other automated tools to access the Services;
•
share your account or sign-in link with anyone else, or access another person's account;
•
use the content to build or train another product, service or model;
•
interfere with or disrupt the Services, or attempt to gain unauthorised access to them or to other users' data; or
•
use the Services in any way that is unlawful or infringes the rights of others.
4. Educational content, not medical advice
4.1 The questions, explanations, annotations, progress estimates and the AI tutor in the App are study aids. They are written for exam practice, are not a substitute for your course materials or clinical training, and may contain errors or be out of date.
4.2 Nothing in the Services is medical advice. Do not rely on it for patient care, clinical decisions or any other purpose outside your own study. If you spot an error, please report it through the App or contact us.
5. FRED and other AI features
5.1 FRED, the AI tutor in the App, and other AI-generated content such as suggested questions and teaching notes, are produced by a third-party AI model. Responses may be wrong, incomplete or misleading, and you should check anything important against a reliable source.
5.2 Do not enter personal information about patients or anyone else when using FRED. How your conversations with FRED are handled is described in our Privacy Policy.
6. Intellectual property
6.1 The Services and all content, questions, explanations, design, text, graphics and software made available through them are owned by us or our licensors and are protected by intellectual property laws. You are granted a limited, personal, non-transferable licence to use them for your own study in accordance with these Terms, and no other rights.
6.2 If you send us feedback, suggestions or reports about a question, you agree that we may use them to improve the Services without any obligation to you.
7. Availability and changes
Bloomed is an early-stage product under active development. We may add, change, suspend or discontinue features or the Services at any time, and we do not guarantee the Services will always be available or error-free. Where we can, we will give you reasonable notice of changes that significantly affect you.
8. Consumer guarantees, disclaimers and liability
8.1 Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
8.2 Subject to clause 8.1, and to the maximum extent permitted by law, the Services are provided "as is" and "as available", we make no warranties that they will be accurate, error-free or uninterrupted, and we are not liable for any loss arising out of or in connection with your use of the Services, including any reliance on their content or on the AI tutor.
9. Privacy
Our handling of personal information is described in our Privacy Policy at studywithbloomed.com/privacy, which forms part of these Terms.
10. General
10.1 These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.
10.2 We may update these Terms from time to time. The current version is available at studywithbloomed.com/terms with the "Last updated" date shown. Continued use of the Services after changes take effect means you accept the updated Terms.
10.3 If any provision is found unenforceable, the remaining provisions continue in effect.
